    Terms & Conditions

    1. Introduction

    These Terms & Conditions ("Terms") govern your access to and use of EastAfrica.Guide (the "Platform"), operated by Travel and Guide International ("we", "us", "our"), a company registered under the laws of the Republic of Kenya.

    By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

    2. Definitions

    • "User" — any individual or entity accessing the Platform.
    • "Expert" — a verified service provider listed on the Platform's marketplace.
    • "Service" — any offering listed by an Expert on the Platform.
    • "Booking" — a confirmed request for a Service.

    3. Eligibility

    You must be at least 18 years of age and capable of forming a binding contract under applicable law to use the Platform.

    4. Account Registration

    You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

    5. Platform Use

    You agree to use the Platform only for lawful purposes. You must not:

    • Violate any applicable laws or regulations
    • Infringe on the intellectual property rights of others
    • Transmit harmful, offensive, or misleading content
    • Interfere with the Platform's operation or security

    6. Marketplace

    The Platform operates as a marketplace connecting Users with independent Experts. We do not directly provide the Services listed on the Platform. Each Expert is solely responsible for the quality, legality, and delivery of their Services.

    7. Payments & Fees

    Pricing is set by Experts. Any platform fee is set out in the published fee policy at /policies. All prices are displayed in the currency specified by the Expert. Payment processing is handled by our third-party payment partners.

    8. Cancellations & Refunds

    Cancellation and refund terms are governed by our Refund Policy.

    9. Intellectual Property

    All Platform content, branding, design, and code are the intellectual property of Travel and Guide International unless otherwise stated. Users and Experts retain ownership of content they submit but grant us a non-exclusive, worldwide licence to display it on the Platform.

    10. Limitation of Liability

    To the maximum extent permitted by law, Travel and Guide International shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any Services booked through it.

    11. Indemnification

    You agree to indemnify and hold harmless Travel and Guide International, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

    12. Governing Law

    These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, specifically the Data Protection Act 2019. Any disputes shall be resolved through mediation under the Nairobi Centre for International Arbitration (NCIA) before proceeding to the courts of Kenya.

    13. Changes to Terms

    We reserve the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance.
