Expert Agreement
1. Purpose
This Expert Agreement ("Agreement") sets out the terms under which you ("Expert") may list and deliver services through the EastAfrica.Guide marketplace, operated by Travel and Guide International.
2. Expert Status
As an Expert, you are an independent service provider, not an employee, agent, or partner of Travel and Guide International. You are solely responsible for the services you deliver, including their quality, accuracy, and compliance with applicable laws.
3. Onboarding & Verification
All Expert applications are subject to review and approval. We reserve the right to reject or revoke Expert status at any time. You must provide accurate and truthful information during the onboarding process.
4. Service Listings
You agree to:
- Provide accurate descriptions of your services
- Set fair and transparent pricing
- Deliver services as described in your listing
- Respond to booking requests within 24 hours
- Maintain professional standards at all times
5. Revenue & Payments
Platform fees, if any, are those in the published fee policy at /policies at the time a booking is made.
6. Content & Intellectual Property
You retain ownership of content you submit. By listing on the Platform, you grant Travel and Guide International a non-exclusive, worldwide licence to display, promote, and distribute your profile and service listings across the Platform and its marketing channels.
7. Professional Conduct
You agree to:
- Treat all users with respect and professionalism
- Comply with all applicable local laws and regulations
- Not discriminate against users on any grounds
- Maintain appropriate licences, certifications, or permits required for your services
- Not engage in fraudulent, misleading, or harmful behaviour
8. Cancellation by Expert
If you must cancel a confirmed booking, you must notify the user and the Platform at least 48 hours in advance. Repeated cancellations may result in suspension or removal from the Platform.
9. Liability & Insurance
You are responsible for obtaining any necessary insurance coverage for your services. Travel and Guide International is not liable for any claims, damages, or injuries arising from services you deliver.
10. Suspension & Termination
We may suspend or terminate your Expert account if you violate this Agreement, receive repeated negative reviews, or engage in behaviour that harms the Platform's reputation. You may voluntarily deactivate your account at any time by contacting our support team.
11. Confidentiality
You agree not to disclose any confidential Platform information, including proprietary algorithms, business strategies, or user data, to any third party.
12. Governing Law
This Agreement is governed by the laws of the Republic of Kenya. Disputes shall be resolved through mediation under the Nairobi Centre for International Arbitration (NCIA) before proceeding to Kenyan courts.
13. Changes to Agreement
We may update this Agreement periodically. If material changes are made, you will be notified and may be required to re-accept the updated terms to continue listing on the Platform.
